You agree to
provide true, accurate, current and correct information about yourself. You
also agree to maintain and update your information on your profile page.
You affirm
that you are either at least 18 years of age or possess legal parental or
guardian consent, and are fully able and competent to enter into the terms,
conditions, obligations, affirmations, representations, and warranties set
forth in this Agreement, and to abide by and comply with this Agreement.
Rent-by-Mail
Membership Plans
Our Rent-by-Mail rental
program is a prepaid membership that entitles members to have out 1, 2, 3, or 4
audiobook selections at a time based on their membership. They can
exchange these selections as often as they like within the period of the
membership. There are no late fees or due dates and shipping is free both ways.
All
audiobook selections are on compact disc. A maximum of 10CDs are shipped at one
time. Audiobooks longer than 10CDs are divided into separate selections.
Members
should keep a minimum of 15-20 titles on their rental shelves at all times to
ensure optimum service. Rental selections do not have due dates, so title
availability is never guaranteed
Members are
responsible for reporting any issues including, but not limited to, titles lost
en route or on return, damaged discs, missing discs, etc. Members must
report such issues as soon as they occur.
Membership
Fees and Billing
As a member
of TBW Audiobooks, you agree to pay the cost of membership for the period you
choose at the beginning of your membership, plus any applicable taxes and any
other charges you may incur in connection with your use of TBW Audiobooks’
rental service. You also agree that we are permitted to charge your credit card
for these fees.
Your
membership will be renewed automatically unless you cancel your membership and
return all outstanding rentals. You must cancel your membership and return all
outstanding rentals before your membership renewal date in order to avoid
billing of membership fees to your credit card. The membership fee will be
billed at the beginning of your membership and on each renewal period
thereafter unless and until you cancel your membership. Membership dues,
including promotional pricing and limited time offers, are subject to change at
a pre-specified time, or at TBW Audiobooks’ discretion. All memberships,
including redeemed gift memberships or special offers, require a valid credit
card on file for security reasons as well as for renewal of your membership.
You may upgrade your membership at any time.
In the event
you fail to pay the membership fee, any applicable taxes, and any other charges
you may incur, TBW Audiobooks may take all remedies against you to collect such
fees owed and may recover from you all costs and expenses incurred by TBW
Audiobooks to collect such fees.
Fulfillment
and Rental Shipping
Audiobook
rental requests are fulfilled Monday to Friday. We will send you a confirmation
email when you return an audiobook and when we send you another audiobook. You
can view current rental items by visiting My Account.
Rental
shipments are postage prepaid and take an average of 2-6 business days each
way. Actual delivery times may vary depending on your delivery address,
when your order was placed, and circumstances affecting delivery by Canada Post
(e.g. holidays). We will send you an email letting you know when we have
shipped your audiobook. TBW Audiobooks is not responsible for delayed or
misdirected mail.
Members may
return rented audiobooks to a Talking Book World store and pick up another
available title.
Free
Trial
The free trial is for a two week period starting from the day that the
titles are shipped. The membership will automatically continue at the three month two selection subscription
rate if audiobooks are kept out past the expiry date. The membership can be cancelled any time, by
email or phone. All books on rent must be returned in order for the membership
to be cancelled. There is a 7 day grace period for the books to be
returned before your credit card will be charged. A credit card is required to
be on file for any of our rental programs.
Caring for Rented CDs
You agree
and undertake to:
handle the CDs with care so as not to damage them
never keep CDs in direct sunlight or heat
always keep the CDs in their rental sleeves when
not in use
treat the CDs and their packaging with the utmost
care at all times.
report damaged CDs to TBW Audiobooks by email or a
note within the rental box with the number of the CD that is damaged.
TBW
Audiobooks reserves the right to charge the current retail price for any
audiobook that is not returned to TBW Audiobooks upon termination of membership
or which is returned in a non re-usable condition (reasonable wear and tear
excepted). The price charged will be equal to the retail price posted on TBW
Audiobooks’ website. TBW Audiobooks will email you before charging your credit
card.
Privacy and Security
You are responsible for
maintaining the confidentiality of your account and password and for
restricting access to your computer. We will not sell or distribute your email
address to a third party.
General
Audiobook publishers are
responsible for the content they produce. We are not responsible for the
content contained on audio CDs or cassettes rented or purchased from TBW
Audiobooks. We are also not responsible for any advertising or
descriptions of the product provided by the publishers. We cannot issue
refunds based on the content of audiobooks.
Limitations on
Liability
We reserve the right to
terminate or restrict your use of our service, without notice, for any or no
reason whatsoever.
We make no representations
or warranties of any kind on the TBW Audiobooks service, website and site
contents. In no event will we be liable to you for any special, incidental,
indirect or consequential damages of any kind.
These Terms
of Use govern your use of the TBW Audiobooks Web site, service and products. By
using, visiting or browsing the TBW Audiobooks web site or using TBW Audiobooks
services or products, you accept and agree to be bound by these Terms of Use.
If you do not agree to these Terms of Use, you should not use the TBW
Audiobooks web site, service or products.
